Colorado Court Bars Trump from 2024 Ballot ,citing Capital Hill attack

 

A Colorado appeals court ruled on Tuesday that former President Donald Trump cannot appear on the state's 2024 presidential primary ballot due to his actions surrounding the January 6th Capitol attack. This decision, based on Section 3 of the Fourteenth Amendment, prohibits individuals who engaged in "insurrection or rebellion" from holding federal office.

The 4-3 vote marks the first time a presidential candidate has been disqualified under this provision. Trump's campaign has already pledged to appeal, setting the stage for a potentially lengthy legal battle.

The court's rationale centers on Trump's potential disqualification from holding any federal office after taking an oath to uphold the Constitution. Despite the lower court's argument that the presidency wasn't explicitly listed in the affected positions, the appeals court disagreed, deeming it implicit.

Reactions to the decision were swift and divided. Noah Bookbinder, representing the initiating group Citizens for Ethics, hailed it as a "momentous victory for democracy." Trump's campaign, however, vehemently denounced the ruling as "undemocratic," accusing the "Democrat-appointed" judges of bias and acting on behalf of "left-wing interests." They further claimed the Democrats, fearing loss to Trump's "growing poll lead," were resorting to desperate measures to keep him off the ballot.

This Colorado case is part of a broader legal landscape concerning Trump's potential ineligibility for future office, with similar lawsuits pending in other states. Minnesota's Supreme Court recently dismissed a similar attempt, highlighting the complexity and uncertain outcome of these challenges.
